Relationship to the main Terms
These Portal Terms supplement the Terms of Service whenever you access a Bespoke student, parent, tutor-facing or customer portal, currently provided on a separate Bespoke application domain. The main Terms and accepted Order Summary control price, lesson delivery, cancellation and refunds. The Privacy Policy controls personal-information processing.
If a Portal-specific rule conflicts with the main Terms, the main Terms prevail unless the Portal rule is more specific to the digital feature and does not reduce a mandatory right. Accessing a portal does not create a separate paid subscription unless an Order Summary clearly says so.
Accounts, authentication and authority
Use accurate information, maintain a secure email and authentication method, and keep credentials confidential. Do not share an account outside the authorised household or organisation. You are responsible for activity you authorised and must promptly report suspected compromise; you are not responsible for activity caused by our security failure or another matter the law places on us.
Parent and student views may differ. A contracting parent may access a minor’s administrative and progress information subject to law, safety and the student’s rights. When a student reaches adulthood, we may verify identity and adjust permissions. School or organisational administrators must access only records they are authorised to manage.
Portal features and educational records
The Portal may provide schedules, credits, invoices, session links, tutor notes, progress information, resources, messaging and optional integrations. A displayed credit or schedule is a service record; report a discrepancy promptly. The underlying contract and verified transaction records control if a display error occurs.
Progress indicators, practice scores, tutor notes and dashboards are educational aids. They may be provisional and do not replace official school or exam-board records. We may correct an evident data error and will preserve an audit trail where reasonably necessary.
No guaranteed outcome
No portal score, forecast, plan, badge, AI response or tutor note guarantees a grade, exam result, admission, scholarship or improvement.
Acceptable use
- Use the Portal only for the participating learner, authorised family, school or service relationship.
- Do not probe security, bypass access controls, scrape at scale, introduce malware, overload the service or attempt to identify another user.
- Do not upload unlawful, threatening, discriminatory, sexually exploitative, privacy-invasive or infringing content.
- Do not use the Portal to cheat, impersonate a student, submit AI output contrary to school rules, distribute restricted exam content or harass a tutor or learner.
- Do not copy, sell, publicly post or use Portal content or user data to train a model without written permission and a lawful basis.
- Report vulnerabilities privately to security@bespokelearning.io and do not exploit or disclose them before we have a reasonable remediation opportunity.
Your content and Bespoke content
You retain ownership of original work you upload. You grant Bespoke a limited, worldwide licence for the contract period and necessary retention period to host, copy, annotate, transform for accessibility, display to authorised participants and otherwise process that work solely to operate, secure and improve the contracted educational service. This licence is not permission to sell the work or train a public general-purpose model.
Bespoke and its licensors own Portal software, design, question banks, templates, lesson resources and branding. Paid users receive only the personal educational licence stated in the main Terms. Feedback about the Portal may be used without identifying you, but confidential information remains protected.
Connected accounts and integrations
If you connect Google Calendar, Drive, Docs or another service, we request only permissions needed for the feature. The consent screen describes the scopes. You may revoke access through the provider or Portal; revocation stops future access but may not delete data already lawfully copied into an educational record. Contact privacy@bespokelearning.io for deletion rights.
An external service has its own terms and availability. We are responsible for our configuration and use of received data, not the provider’s independent systems. We do not transfer connected-account data for advertising and apply any provider-specific limited-use policy that governs the integration.
AI-assisted and automated features
An optional AI coach or assistant may generate explanations, study prompts, summaries or feedback. It can be wrong, incomplete or unsuitable. Do not use it for emergencies, medical or mental-health advice, legal advice, an official grade, or as a substitute for teacher instructions. Verify important output and follow academic-integrity rules.
We identify when content is AI-generated and provide feature-specific privacy information. A material educational or account decision will not be based solely on automated processing without the lawful basis, notice, human review and appeal safeguards that apply. We may restrict an AI feature for age, safety, integrity or provider reasons.
Messaging, sessions and recordings
Portal messages should be used for service-related communication and are not continuously monitored for emergencies. For immediate danger, contact local emergency services and a responsible adult. We may review reported or lawfully flagged content to protect users, investigate abuse and enforce these Terms.
A session link does not authorise secret recording. Recording or transcription is governed by the meeting notice, Privacy Policy and participant-location law. Users may not download or redistribute a recording, transcript or tutor communication except for the participating student’s private study and only where permitted.
Availability, maintenance and support
We use reasonable care to maintain the Portal but do not promise uninterrupted or error-free operation. Planned maintenance and urgent security work may limit access. We aim to provide notice of material planned downtime and restore service reasonably quickly.
If Portal failure prevents a paid lesson, the lesson-cancellation remedy in the main Terms applies. For other loss of access, contact support@bespokelearning.io. Keep local copies of student work where practical; the Portal is not an archival service unless expressly stated.
Security monitoring and enforcement
We may log access, device, security and administrative actions proportionately to operate the service, prevent abuse and investigate incidents. We do not use security monitoring as a pretext for behavioural advertising.
We may remove unlawful or infringing content, limit a feature or suspend an account where reasonably necessary. Except for urgent safety, security, fraud or serious misconduct, we ordinarily notify the account holder and allow a reasonable response. Termination and financial consequences follow the main Terms; Portal suspension does not automatically forfeit prepaid services.
Privacy and accessibility
Personal information is handled under the Privacy Policy, including rights, retention, international transfers and children’s safeguards. Cookie and similar-technology choices are described in the Cookie Policy. Do not upload another person’s sensitive information unless authorised and reasonably necessary.
We aim for accessible digital service and provide reasonable accommodations as described in the Accessibility Statement. Report a portal barrier to accessibility@bespokelearning.io and we will work on an effective alternative.
Liability, governing law and changes
The warranties, liability limits, force-majeure terms, complaint process, Ontario governing law and preservation of mandatory local consumer forums in the main Terms apply equally to the Portal. Nothing excludes reasonable care and skill, privacy obligations or another non-waivable remedy.
We may change Portal functions and these Portal Terms for security, law or improvement. A material adverse change is announced reasonably in advance and does not retrospectively reduce rights for a paid fixed service. If a discontinued feature is essential to a paid service and no reasonable substitute exists, the remedies in the main Terms apply.
